Kingston, 21, was taken into custody in Utah after prosecutors say he sexually assaulted a 20?'year?'old woman on February 23, 2025 in St. George, about 260 miles from BYU's campus in Provo.
The case was investigated by the St. George Police Department before being handed over to the Washington County Attorney's Office.
According to a statement from prosecutors, detectives gathered digital and forensic evidence, interviewed the alleged victim and witnesses, and built a case that led to the felony charge.
Kingston is being held without bail and is scheduled to appear in court Friday afternoon.
BYU acknowledged the arrest in a brief statement, saying the school became aware of the situation Wednesday and is cooperating with law enforcement. Due to privacy laws, the university declined to offer further comment.
"The Washington County Attorney's Office takes allegations of sexual assault seriously," prosecutors added, thanking investigators and medical professionals involved in the case.
Kingston was a key target in BYU's passing game this past season, finishing with 67 receptions, 928 yards and five touchdowns for a 12?'2 Cougars team.
This is a developing situation and further legal proceedings will determine how the case unfolds in the days ahead.
