Senior Tennessee receiver Josh Smith was arrested earlier in the month for an alleged domestic assault committed against his roommate. It turns out that the victim, Kennedy Foster, is looking for quite a serious sum of money in damages despite the fact that the two are supposed to be pretty close friends.

Foster has demanded $875,000 in compensatory and punitive damages by Tuesday, May 30, or he will seek a $3 million civil lawsuit, according to a report by Tennessee radio host Jimmy Hyams:

The incident occurred after Cinco De Mayo and Foster suffered a broken nose, broken teeth, and damage to his eyes and right ear, according to claims by his attorney. Neither side agrees on what exactly happened and Smith's attorney, Keith Stewart, has expressed his feelings on the damages Foster is seeking.
"I'm not accusing him (Foster) of extortion, but that's what it looks like,'' Stewart said. "Given my understanding that Mr. Foster's attempts to press charges against Malcolm Stokes were unsuccessful, it seems his motives are clear.''
Josh Smith has gone before the UT Student Code of Conduct board but a verdict has not been rendered, according to Butch Smith (Josh's father). The senior receiver has taken alcohol anger management classes, but it is not known if Josh Smith has been punished by Volunteers head coach Butch Jones.
