DUI charges against Vols OL dropped

Vols fans have to be happy about this one.

Driving under the influence and speeding charges against Tennessee's Charles Mosley were dismissed Thursday, according to a report from Dustin Dopirak of The Knoxville News Sentinel.

The redshirt sophomore offensive lineman from Brighton, Tenn., had his charges dismissed following a hearing in Knox County General Sessions Court, according to the report. Mosley's, Steve Oberman, attorney told the KNS that the case was dismissed because the state failed to establish probable cause to arrest his client.

"The arresting officer believed he had sufficient grounds to arrest Mr. Mosley," Oberman told the KNS. "The proof presented today in court was insufficient to send the case to the grand jury. ... Mr. Mosley and I are thrilled to have the case concluded in such a favorable fashion."

Mosley's arrest came last July and the incident report suggested that Mosley was driving 79 miles per hour in a 55 mph zone. The arresting officer noted in the report that he detected an odor of marijuana while approaching the vehicle. According to the report, Mosley told the officer he'd been with friends at nearby hotel who'd been smoking, but that he hadn't smoked. The report said Mosley was arrested after performing poorly on a field sobriety test and after the officer found marijuana residue in the front passenger seat and the backseat.

Mosley had been punished by Butch Jones internally and appeared in 12 out of 13 games last season as a reserve. He was also mainly on the second unit of the offensive line during spring practices as well.
