Cellphone video of a North Miami man was released this week that shows that sometimes when you follow the rules, it still isn't good enough for police officers.
Charles Kinsey was approached by officers after concerned citizens called in reports that a man was walking around with a gun, threatening to kill himself.
Despite all of this, and despite the truck being in full visibility of officers, they approached Kinsey and his patient and gave them the all too familiar cry to get down with their hands up.
Kinsey didn't reach for anything, there was no struggle for a possible weapon. He complied with officers.
When his frightened patient began to act up, he did his best to calm him down, given the situation at hand.
7 News Miami caught up with Kinsey from his hospital bed where he is recovering.
"In his hospital bed and wearing bandages, Kinsey said, he was attempting to calm an autistic patient who ran away from a group home. Kinsey could be heard in the video saying, 'All he has is a toy truck. A toy truck. I am a behavior therapist at a group home,'" 7 News reported.
In newly released cellphone video, viewers can hear Kinsey try and calm down his patient, Rinaldo.
"Rinaldo, please be still, Rinaldo. Sit down, Rinaldo. Lay on your stomach," Kinsey shouts.
A few minutes later, his back still planted firmly on the ground, his arms still raised high in the air, Kinsey felt a new type of pain that he likened to a "mosquito bite."
"I'm like this right here (Kinsey raise's his arms), and when he shot me, it was so surprising," Kinsey told 7 News Miami.
"I thought it was a mosquito bite, and when it hit me I had my hands in the air, and I'm thinking I just got shot! And I'm saying, 'Sir, why did you shoot me?' and his words to me were, 'I don't know.'"
North Miami police have yet to release the officer's name or offer a firm statement on the matter.
The state attorney is investigating.
