Butler, of course, made a game-saving interception for the New England Patriots to seal the Super Bowl XLIX victory over quarterback Russell Wilson and the Seattle Seahawks in 2015. Butler's pick came in the end zone with the Seahawks driving for a touchdown that would have given them the lead — and most likely, the win.

Reports say Butler's eyes were bloodshot and he refused a chemical test for exceeding the alcohol limit.

His attorney, former Rhode Island House Speaker John Harwood, has filed a motion to dismiss or suppress the charge. Harwood has argued that Butler said his constitutional rights under the Fourth, Fifth, Sixth and 14th Amendments "were violated."

At the time of his arrest, Butler reportedly told officers to "just take me to jail."

Butler, 34, had just announced his second retirement one week prior to the arrest. The announcement came on March 9, the arrest on March 16.

"I think when they stopped him he wasn't driving," Harwood told WPRI News. "He was off the road, and that he wasn't driving tells me at least he was being responsible."

The outlet added:

"According to a North Providence police report, officers saw a white Mercedes Benz at about 3:22 a.m. stopped in the westbound lane of Mineral Spring Avenue. Police said the car was blocking westbound traffic.

"According to the report, Butler provided officers with a Mississippi driver's license and said he was "coming from a studio in Providence where he was making music."

"While speaking with Malcolm, I could detect a strong odor of alcoholic beverage coming from his breath," the arresting officer wrote. "He also had extremely slurred and delayed speech along with severely bloodshot watery eyes."

Butler was reportedly driving a white Mercedes Benz E300, allegedly blocking traffic. He was pulled over at about 3 a.m. local time.
