The league said Wednesday afternoon that the situations involving Stefon Diggs and Christian Barmore are currently under review under the Personal Conduct Policy.
"There is no change to the status of Diggs or Barmore," the NFL said in a statement, via Pro Football Talk. "Both are eligible to play at this time."
The league added that placement on the Commissioner Exempt List may be considered after formal charges are filed, including an indictment by a grand jury, the filing of charges by a prosecutor, or an arraignment in criminal court.
Diggs is facing felony strangulation or suffocation and misdemeanor assault and battery charges stemming from an alleged Dec. 2 incident at his Dedham, Mass., home. He has denied the allegations through his attorney.
Barmore is scheduled to be arraigned Feb. 3 on a misdemeanor charge of assault and battery on a family or household member related to an alleged August incident in Mansfield. Court records indicate the woman involved later expressed that she did not wish to move forward with charges, though a criminal complaint was issued in December.
The Patriots have acknowledged awareness of both situations and said they are cooperating with the NFL as the legal process continues. For now, both players remain active and available as the league continues its review.
